2. Service Description

Magic Storytime is a personalized storybook creation service that uses artificial intelligence to generate custom illustrations featuring your child as the hero of various story templates. Our Services include:

• AI-powered illustration generation from uploaded photographs
• Customizable story templates with various themes
• Digital preview of personalized storybooks
• Printing and shipping of physical hardcover storybooks

3. User Accounts & Eligibility

You must be at least 18 years old to use our Services. By using Magic Storytime, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Photo Upload & Content Rights

When you upload photographs to our Services, you represent and warrant that:

• You have the legal right to upload and use the photographs
• You have obtained consent from any individuals depicted in the photographs (or are the parent/legal guardian of minors depicted)
• The photographs do not violate any third-party rights, including intellectual property or privacy rights
• The photographs do not contain illegal, harmful, or offensive content

You grant Magic Storytime a limited, non-exclusive license to use, process, and store your uploaded photographs solely for the purpose of providing our Services to you. We do not claim ownership of your photographs and will not use them for any purpose other than creating your personalized storybooks.

5. Intellectual Property

The story templates, illustrations (excluding your likeness), text content, website design, logos, and all other intellectual property associated with Magic Storytime remain our exclusive property or the property of our licensors.

When you purchase a storybook, you receive a personal, non-commercial license to use that specific storybook for private, family use. You may not reproduce, distribute, modify, or create derivative works from our story templates or illustrations for commercial purposes.

6. Payment & Refund Policy

All prices are displayed in US dollars and are subject to change without notice. Payment is required at the time of order and is processed securely through our payment provider.

Refund Policy: Due to the custom, personalized nature of our products, we generally cannot accept returns or issue refunds for completed orders. However:

• If your book arrives with printing defects or shipping damage, we will replace it at no additional cost
• If we are unable to fulfill your order for any reason, you will receive a full refund
• You may cancel an order before it enters production for a full refund

7. Privacy & Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to our data practices as described in the Privacy Policy.

8. Children's Privacy

Magic Storytime is a service for parents and guardians to create personalized books for children. Our Services are not directed at children, and we do not knowingly collect personal information directly from children under 13.

Parents and guardians who use our Services to create books featuring their children represent that they have the authority to provide such information and consent to its use as described in these Terms and our Privacy Policy.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Magic Storytime and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill.

Our total liability for any claim arising from or related to these Terms or our Services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Disclaimer of Warranties

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our Services will be uninterrupted, error-free, or completely secure.
